Terms of use

1. Introduction

These terms of use (the Terms) govern your access to and use of the QZee platform, websites and apps (together, the Platform), operated by QZee Ltd (QZee, we, us or our). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

2. Definitions

• Business: a venue or service provider that uses QZee to take and manage bookings.
• Customer: a person who books a service through a Business's QZee page.
• Business app: the tools a Business uses to run its venue and bookings.
• Booking app: the customer-facing experience used to find and book services.

3. Eligibility and your account

You must be at least 18 years old and able to enter into a binding contract to use the Platform. You are responsible for the accuracy of the information in your account and for keeping your login credentials secure. You are responsible for all activity that takes place under your account.

4. Plans and the QZee service

QZee offers QZee Free at £0 per month and QZee Pro at £14.99 per month. Plan features and prices are shown on our pricing page and may change from time to time. There are no long-term contracts. You can cancel your subscription at any time, and Pro access will end at the close of your current billing period.

QZee Free and QZee Pro each include one active bookable staff seat. Each additional active bookable staff seat costs £5 per month on either plan. Added seats are charged pro-rata immediately, including during a Pro trial. Seat reductions take effect at the next staff-seat renewal. Paid staff seats continue after Pro is cancelled unless they are separately reduced or cancelled. QZee does not add VAT.

Eligible UK businesses may receive one optional seven-day QZee Pro trial during onboarding. Card details are required. Unless you cancel before the recorded trial end, the trial converts to QZee Pro at £14.99 per month. Cancelling during the trial keeps Pro access until the trial ends.

5. Bookings and payments

Payments are processed by Stripe; by taking payments through QZee you also agree to Stripe's applicable terms. A QZee booking fee of 3% + 25p applies per paid booking, in addition to any subscription fee for your plan. No VAT is added to QZee's 3% + 25p booking fee. Stripe's standard processing fees also apply and are paid by the business. Connected payments are available to UK businesses that complete Stripe verification. Payouts are made to the Business's connected account.

Contracts for services booked through QZee are between the Business and the Customer. The Business is responsible for delivering the booked service and for setting and applying its own cancellation, refund and rescheduling policies. QZee provides the booking and payment tools but is not a party to the service contract.

6. Acceptable use

You agree not to use the Platform to:

• break the law or infringe the rights of others;
• upload harmful, misleading, or unlawful content;
• upload, submit, transmit or link to any code, script, malware, or other active or executable content, or otherwise attempt to compromise the security of the Platform or of any other user;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the Platform; or
• misuse customer data or send unlawful marketing.

7. Your content and branding

You retain ownership of the content and branding you add to your QZee page. You grant us a licence to host, display and use that content as needed to operate and promote the Platform and your booking page. You are responsible for ensuring you have the rights to any content you upload and that it is lawful and safe.

You are responsible for the content you add to your QZee page, including any terms and conditions or other text shown to Customers. To the fullest extent permitted by law, you agree to indemnify QZee against any claims, losses, liabilities and costs arising from the content you upload or from your breach of the acceptable use terms above, including any harm caused to Customers or other third parties.

8. Intellectual property

The Platform, including its software, design and trademarks, is owned by QZee or its licensors. These Terms do not transfer any of our intellectual property rights to you.

9. Data protection

We process personal data in accordance with our privacy policy. Where you handle Customer personal data through the Platform, you are responsible for doing so in compliance with applicable data protection law.

10. Availability and changes

We work to keep the Platform available and reliable, but we do not guarantee it will always be uninterrupted or error-free. We may add, change or remove features, and we may carry out maintenance that temporarily affects availability.

11. Disclaimers and liability

The Platform is provided on an as is and as availablebasis. To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, loss of profits, or loss of data. Nothing in these Terms limits liability that cannot be limited by law. Subject to that, our total liability is limited to the fees you paid to us in the 12 months before the claim.

12. Suspension and termination

You may stop using the Platform and close your account at any time. We may suspend or end your access if you materially breach these Terms or use the Platform in a way that risks harm to QZee, other users, or third parties. On termination, the rights granted to you under these Terms will end.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know. Your continued use of the Platform after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to them.
